
Himson Engineering Private Limited, Surat, Gujarat, has issued a public notice concerning patent rights related to a false-twist texturing machine used for processing multifilament threads.
The notice states that Oerlikon Textile GmbH & Co. KG, Germany, is the registered proprietor of Indian Patent No. 316763, titled “A False-Twist Texturing Machine For The Texturing Of A Plurality Of Multifilament Threads.” The patent is valid and currently in force.
As per the notice, Himson Engineering has been granted a sole licence by Oerlikon to use, manufacture, market, and commercialise the patented technology within the territory of India. The technology relates to manmade fibre spinning systems and texturising machines used in the textile industry.
The public notice cautions that any person or entity that uses, manufactures, sells, offers for sale, imports, or otherwise deals in products or processes falling within the scope of the patented technology without authorisation would be considered to be infringing the patent under the Patents Act, 1970. Such actions may lead to legal consequences, including injunctions, damages, and recovery of losses.
The notice further states that Oerlikon and Himson reserve the right to take appropriate legal action, individually and/or jointly, against any party found infringing or assisting in the infringement of the patented technology.
